Constitutional Protections

Liability for those who cause harm to the environment is recognized in some country constitutions –  often included under provisions protecting the right to a clean and/or healthy environment, or the right to life.  Although these are not necessarily framed in terms of specific liability provisions, in many countries they have formed the basis for liability cases seeking remedies for harm.
